The Southern Bangkok Criminal Court has dismissed a defamation lawsuit filed by the Bhumjaithai party against the renowned former politician, Chuwit Kamolvisit. The lawsuit was initiated in response to Chuwit’s criticism of the party’s cannabis policy during the 66th general election. The court ruled that Chuwit’s comments were made in good faith and were a fair critique, not violating any election laws.
On September 28th, the Southern Bangkok Criminal Court ruled that the case filed by theBhumjaithai Thai party against Chuwit Kamolvisit, a well-known former politician, for defamation and violation of the Constitution Act regarding the election of House Representatives of 2018, was without merit. The case revolved around Chuwit’s criticism of the party’s cannabis policy.
The court recognized that Chuwit had the freedom of speech and expression as per the 2017 Thai Constitution. The statements made by Chuwit were factual and widely known, especially in major cities and tourist areas like Sukhumvit, Khao San Road, Pattaya, and Phuket, where numerous cannabis shops operate. Even though Chuwit criticized the party’s previous election policy, he did not spread false information. He expressed genuine concerns and provided constructive criticism, which is a right of the citizens.
Regarding the allegations that Chuwit’s comments were misleading and caused public panic, the court found no evidence to support this claim. Chuwit’s actions did not violate any election laws or the Penal Code’s provisions on causing public panic with false information.
